As lawful consideration and as a condition to the undersigned guest (the “Participant”) entering onto the property owned and operated by Eagle Pointe, Inc. (“Eagle Pointe Lodge”) and participating in activities organized or provided by Eagle Pointe Lodge (the “Events”), which include but are not limited to boating, fishing, kayaking, hiking, and use of lounge amenities, the Participant acknowledges, appreciates, and agrees to the following:

1. The activities available to be participated in during a visit to or stay at Eagle Pointe Lodge have foreseeable and unforeseeable inherent risks, hazards and dangers, which are significant, including the risk of the potential for permanent paralysis and death, and while certain rules, equipment and personal discipline may reduce this risk, the risk of serious injury does exist.
2. The Participant is advised that there are personal floatation devices and appropriate protective gear on board vessels for their use while on or near the water due to the many risks, dangers and hazards associated with boating and fishing, including but not limited to accidents which occur during transportation or travel to and from the Events, impact and collision with rocks, trees, logs, deadfall, boats, rafts, equipment or other vessels, drowning, changing and inclement weather conditions including storms, high wind, high waves, and lightning, and encounters with domestic or wild animals and fish.
3. The Participant KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, including but not limited to the risk of serious injury, permanent paralysis, or death, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF PARTICIPANTS, EAGLE POINTE LODGE OR OTHERS, and assumes full responsibility for participation in the Events at Eagle Pointe Lodge.
4. Negligence includes the failure of Releasees to take reasonable steps to safeguard or protect the Participant from or warn of the risks, dangers and hazards referred to herein.
5. The Participant willingly agrees to comply with the stated customary terms and conditions for participation in the Events. If, however, the Participant observes any unusual or significant hazards during their presence or participation in the Events, the Participant will immediately remove themself from participation and bring such hazard to the immediate attention of the nearest official.
6. The Participant, and on behalf of their heirs, assigns, personal representatives and next of kin, HEREBY RELEASES AND HOLDS HARMLESS EAGLE POINTE LODGE, its officers, directors, officials, shareholders, agents, employees, subcontractors, affiliates, other participants, sponsoring agencies and advertisers, (collectively the “Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER CAUSED BY THE NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT OF THE RELEASEES OR OTHERWISE resulting directly or indirectly from the Participant’s stay at Eagle Pointe Lodge and the Participant’s participation in any of the Events. The Participant covenants not to make or bring any such claim against Eagle Pointe Lodge or any other Releasee and forever releases and discharges Eagle Pointe Lodge and all other Releasees from liability under such claims.
7. The Participant hereby authorizes Eagle Pointe Lodge the right to take, edit, alter, copy, exhibit, publish and distribute and make use of any pictures or videos taken of the Participant to be used in promotional materials, including but not limited to newsletters, websites, social media sites and other print and digital communications without payment or any other consideration.

This is to certify that I, as a parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and for myself, my heirs, assigns, and next of kin. I release and agree to indemnify the Releasees from any and all liabilities arising from my minor child’s involvement or participation in the activities identified above at Eagle Pointe Lodge.
